European Commission opens targeted consultation on copyright environment for creativity and innovation (AI implications)

On 29 September 2026 the European Commission opened a targeted consultation 'to support a better copyright environment for creativity and innovation' under its Digital Strategy workstream, addressing how the copyright framework should operate in the digital/AI era and complementing the AI Act's Article 50 transparency rules and the Code of Practice on AI-generated content.
EU copyright rules are the key lever governing what training data AI providers may use in the EU and how AI-generated content interacts with transparency duties; outcomes will shape AI Act-adjacent obligations (TDM licensing, opt-outs) affecting every EU-facing provider and deployer.
AI providers and content platforms operating in the EU should monitor and consider responding to the consultation; the AI Act Article 50 transparency obligations already in force (since 2 August 2026) continue to apply regardless.
