What happened
The European Commission adopted a Delegated Regulation (published/briefed the week of September 21, 2026) amending Annex I of Regulation (EU) 2021/821, the EU's dual-use export control list. The 2026 update adds new controls including advanced computing integrated circuits and electronic assemblies, semiconductor manufacturing and testing equipment, advanced materials, and technology for their development, aligning EU controls with Wassenaar, Australia Group, and Nuclear Suppliers Group commitments.
Why it matters
This tightens EU controls on AI-relevant compute hardware and chipmaking equipment — the physical supply chain for AI development — requiring EU export licenses for advanced computing ICs to many destinations. It materially affects AI infrastructure procurement, semiconductor vendors, and cloud/AI companies shipping or receiving controlled computing items within or through the EU.
Action needed
Exporters and re-exporters of advanced computing ICs, semiconductor manufacturing equipment, and related technology should re-screen their product classifications against amended Annex I of Regulation (EU) 2021/821 and obtain the required EU export authorizations.
