What happened
On July 22-23, 2026, White House OSTP Director Michael Kratsios publicly accused Beijing-based Moonshot AI of large-scale 'adversarial distillation' of Anthropic's Fable model to build its open-weight Kimi K3 model, and alleged Moonshot used export-controlled Nvidia GB300 chips diverted to Thailand. Treasury Secretary Scott Bessent stated the administration 'has the ability to sanction' Chinese AI labs and would examine Chinese open-source models for IP theft. Congressional committees separately confirmed an inquiry examining a pattern of conduct by Chinese AI labs involving large-scale theft of proprietary capabilities from American frontier AI systems through adversarial distillation. Commerce has also been reported (per contemporaneous reporting) to be considering adding several Chinese AI labs to the Entity List.
Why it matters
This is an emerging national-security/export-control action targeting a specific foreign AI lab's ability to access US chips and distribute models used by US companies; if formalized via Entity List addition or sanctions, it would materially restrict US organizations' ability to access or run Moonshot/Kimi K3 and similar Chinese open-weight models domestically.
