Sen. Warner (D-VA) Introduces 'Secure AI Development Act' Mandating NSA Pre-Release Testing of Frontier AI Models

On July 21, 2026, Sen. Mark Warner (D-Va.), vice chairman of the Senate Intelligence Committee, introduced the Secure AI Development Act as part of a broader AI legislative framework. The bill would require developers of 'frontier' AI models capable of autonomously exploiting cybersecurity vulnerabilities to register with NIST and submit models to an NSA-led Artificial Intelligence Security Center 21 days before public release. It also directs NSA to establish a secure test-bed for critical infrastructure operators to evaluate frontier model impacts, modernizes AI vulnerability disclosure processes, and creates a voluntary AI safety incident reporting system.
This is the first Senate bill to propose converting the Trump administration's voluntary 30-day pre-release testing framework (June 2026 executive order) into a mandatory statutory regime with NSA oversight. If enacted, it would fundamentally change compliance obligations for frontier AI labs (OpenAI, Anthropic, Google DeepMind, etc.) by imposing binding pre-release security review requirements enforced by a national security agency rather than voluntary cooperation.
Frontier AI developers should monitor committee referral and markup; no binding obligation exists yet as this is a newly introduced bill, not enacted law.
